PUBLIC CONTRACT
(Public Offer)
for the provision of services on the organization of additional education
(learning Russian as a foreign language)
in accordance with article 407 part 2 of the Civil code of the Republic of Belarus
Version 05.03.2017
This Public Сontract (hereinafter "Сontract") defines the procedure for the provision of organization of additional education and related services, based on the chosen program, as well as mutual rights, responsibilities and the relationship between limited liability company "Сity Lingva" (hereinafter referred to as "Service Provider"), acting under of Certificate of state registration No. 191761184 of 30.07.2012, and the purchaser of services (hereafter "Customer"), accepted the public offer (hereafter "Offer") on the conclusion of this Сontract.
1. Terms and Definitions
1.1. For the purpose of the present Offer, the terms given below are used in the following meaning:
Offer – the Service Provider’s proposal, addressed to any individual, to conclude the Agreement on the terms contained in this Offer.
Publication – placement of the text of this Offer at free access on the Internet at http://privet.city-lingva.com/en/offer-en.
System – information system of learning Russian as a foreign language; the System’s address on the Internet is http://privet.city-lingva.com.
Services – services, provided by the Service Provider under learning Russian as a foreign language. The list of services, provided for a fee, and the payment procedure can be found here: http://privet.city-lingva.com/en/buy.
Offer Acceptance – the full and unconditional acceptance by the Customer to the terms of the Offer, recognized by the conclusion of the Сontract, by the Customer’s payment of Services in the System on the website http://privet.city-lingva.com.
2. The offer
2.1. Offer includes the Appendix, as its integral part:
Appendix No. 1. The price for learning Russian as a foreign language.
3. Subject and General Terms
3.1. In accordance with the present Offer the Service Provider shall provide the Customer services for learning Russian as a foreign language, and the Customer shall pay for these services (if relevant).
3.2. The List of services provided by the Service Provider to the Customer based on the present Offer shall be determined by the Customer by payment on the website http://privet.city-lingva.com.
3.3. The Customer’s confirmation of data entered in the identification fields on the payment page when filling it on the Service Provider’s website implies a full and unconditional acceptance of the present Offer.
4. Timeline for Provision of Services
4.1. The Service Provider starts providing services no later than 1 (one) working day either from the date of the Customer’s filling in the Application in the System or from the date of the Service Provider’s receipt of the service fee, when the services are processed by the Service Provider for a fee. The service’s performance time limit includes the amount of orders and services selected by the Customer.
5. Price and Payment Procedure
5.1. The Customer clicks Pay button on the website of the System and will be redirected to a special protected payment page of bePaid processing system. There is the name of the chosen issue and the sum to be paid.
5.2. The Customer enters the bank card data, completes the identification fields and clicks “Confirm payment” button to confirm the payment.
5.3. The cost of an issue is denominated in Belarusian rubles (BYN). When paying with a card in a different currency, it will be converted at the actual exchange rate of the issuing bank.
5.4. On completing the payment, the Customer will receive a confirmation at the e-mail address they provided in the customer identification field on the payment page.
5.5. Within 1 (one) working day upon completion of the payment you will receive the chosen issue at the e-mail address the Customer provided in the customer identification field on the payment page.
5.6. The Service Provider accepts Visa, Visa Electron, MasterCard, Maestro and Belcard bank cards.
The payments with bank cards are made through bePaid electronic payment system. The payment page meets all the requirements of secure data transmission (PCI DSS Level 1). All the private data are kept encrypted which provides maximum security.
5.7. After invoice payment or the Customer’s application transfer to the Service Provider, the Customer shall not be entitled to refuse the receipt of services upon the paid Application. The funds received by the Service Provider are non-refundable.
6. Service Terms and Conditions
6.1. The Service Provider undertakes to inform the Customer about the course of providing services.
6.2. The List of services provided by the Service Provider is available to the Customer when logging in to his/her account.
6.3. The Customer undertakes to provide the Service Provider with all the necessary information and documents, including personal data, for rendering services.
6.4. The Customer agrees to the processing of his/her personal data in order to implement the provision of services by the Service Provider for the entire duration of the Application and within 4 years from the date of closing of the Application, in accordance with the statutory requirements.
6.8. The Customer assures the Service Provider that the ordered services will not be used for illegal purposes, against the interests of any citizens, states, governments, officials, organizations and world order in general. The order for rendering services under the present Offer is not related to the Customer’s legalization of funds obtained by criminal means.
7. Notices and notifications
7.1. The parties unconditional recognize the legal effect of the texts of the documents received via communication channels (e-mail) along with the documents executed in simple written form on paper, except for the cases when the documents on the paper carrier is required.
7.2. The parties unconditional agree that all correspondence, notices and notifications and the payment of claims ordered by the Customer services received at the e-mail address shall be deemed delivered to the addressee in due form.
7.3. The parties shall promptly verify the correspondence that comes to their email address.
7.4. The Service Provider reserves the right of informing the Customer by means of the electronic widgets placed on the Service Provider's website and email notifications.
7.5. The parties agree that implicitly recognize the legal effect of the data residing in the electronic widgets and notifications, except when the processing of paper documents is mandatory under the requirements of this Contract.
7.6. All risks associated with the onset of adverse effects due to non-compliance with the requirements specified in clauses 7.3-7.5 hereof, shall be the party who committed such violation.
8. Miscellaneous
8.1. The terms of the present Offer are governed by the laws of the Republic of Belarus and international rules.
8.2. The Service Provider reserves the right to modify the Offer’s terms and/or withdraw the Offer at any time at his discretion. In the event of changes in the Offer made by the Service Provider, such changes will become effective upon posting of the modified text of the Offer on the Service Provider’s website, if no other effective date of changes is defined.
8.3. The parties unconditional agree that this Contract is concluded at the address of the Service Provider's location.
8.4. All disputes or differences arising between the parties under this Contract shall be settled through negotiations (with mandatory writing), failing a peaceful settlement in accordance with the legislation of the Republic of Belarus.
8.5. If any of the terms of this Contract becomes null and void, unlawful, or excluded from this Contract, it does not entail the invalidity of the remaining terms of this Contract, which will remain in legal force and are binding on all parties.
8.6. All issues not regulated hereby shall be resolved in accordance with the current legislation of the Republic of Belarus and local normative documents of the Service Provider, subject to their compliance with the current legislation of the Republic of Belarus.
9. Details of the parties
9.1. The parties unconditional agree details of the Customer to read the information provided to them at checkout for the provision of services and payment of services, including address of residence, name and surname.
